UPDATE ON THE CASE BETWEEN YEAC, FYNEFACE DUMNAMENE AND MAO NANGI

Recall our communication in July on the above subject matter and subsequent update that the case of Mao Nangi character defamation suit at the High Court sitting in Port Harcourt has been adjourned to October 12, 2022 for hearing and/or ruling on his motion for some Advocacy Centre’s documents to be struck out from the case.

Ahead of tomorrow’s court sitting and possible ruling on his motion for the court to strike out some of our documents, we wish to inform you, our members, supporters, local and international development partners that Mr. Nangi has filed another motion again, this time asking the court to strike out “Youths and Environmental Advocacy Centre” from the suit entirely.

He is arguing that YEAC-Nigeria is not “recognized” by law therefore it is not a legal entity that can sue and be sued in a court of law. Surprised as you might be right now to hear this for a Corporate Affairs Commission (CAC) duly and legally registered and certificated organization like YEAC-NIGERIA, his position’s undertone is that our suit didn’t contain the phrase “incorporated trustee of….” before writing “Youths and Environmental Advocacy Centre”.

This like the other motion for our documents to be struck out are mere strategies to escape justice over the dirty things he vomited out against YEAC-NIGERIA and FYNEFACE after he earlier lost the bid to strike out the entire suit over lack of jurisdiction claim.

Note that if the court strikes out YEAC-Nigeria from the suit on this basis it does not mean that the case has ended but that it would now remain only Fyneface Dumnamene Fyneface as the claimant and himself as the defendant.

Thus, while our lawyer has responded to these claims as required by law to the court ahead of October 12, we call on our members, supporters, local and international development partners that are interested in this case and have been following latest developments on it not to panic as the court takes its decision on the matter and we will study the outcome and know what next steps to take.
